Employers in California and across the country all face a common enemy: Class Action Lawsuits! Those can be more than expensive pains-in-the-neck; they spell doom for many employers who are just one lawsuit away from bankruptcy. Employers who try their best to follow the law and even go above and beyond to treat their employees like family often find themselves in the cross-hairs of a disgruntled employee and his/her unreasonable attorney looking for a payday. But employers need not wait for disaster to strike; employers can take action now to prevent and prepare for class action lawsuits. This briefing will focus on the recent increase in class actions against employers in 3 areas: (1) wage and hour; (2) background checks; and (3) privacy and data security. We will discuss, among other things, the recent split between the federal circuit courts of a appeals on the enforceability of class action waivers in arbitration agreements, as well as steps that employers can take to not fall victim to the class action industry.
