In an interview with Law360, Todd Logsdon discusses how OSHA’s push to enact a permanent standard to address COVID-19 in the health care industry is likely the most pressing workplace safety regulatory issue facing employers in that arena. Todd notes that any permanent standard is “probably going to capture more health care employers than the ETS did,” and he warns that “some health care settings that were exempted from the ETS could be pulled into this regulation." He also discusses the likelihood of a proposed rule that would broadly address infectious disease threats in the workplace. Todd indicates that it remains to be seen whether the proposed infectious disease rule will come through, but if it does then it will most likely be more expansive than what OSHA's COVID-19 health care regulations encompass.
