This webinar will cover the benefits and risks of employing independent contractors with the primary focus on the applicable legal standards that apply at the federal, state, and local levels in determining independent contract status. Additionally, the session will cover statute specific developments, such as the recent NLRB decision in The Atlanta Opera, Inc. that changed the test for determining independent contractor status under the National Labor Relations Act. Further, the session will address potential overtime liability under the FLSA and applicable state wage and hour laws for workers misclassified as independent contractors.
The session will also cover recent developments, including cases and regulations in the United States and Europe, on extending benefits to independent contractors. Finally, the session will provide drafting tips to enhance the enforceability of independent contractor agreements.
The firm will submit this program for HRCI and SHRM credit.
