In January the U.S. Department of Labor issued a new independent contractor rule that will tilt the playing field in favor of classifying more workers as employees, rather than as contractors. Employers should expect the federal agency to make this rule an enforcement priority, and plaintiffs attorneys will try to use it to their advantage as well. It is therefore critical for employers to understand the new rule and evaluate and restructure their workforce accordingly.
