In California, hospitality employers are being bombarded by lawsuits. Both single plaintiff and representative claims are swamping our courts. In addition, these lawsuits take time away from the business, are costly to defend, and present a great amount of risk to the hospitality business. For these reasons, parties will often consider settling disputes using various alternative dispute resolution (ADR) channels such as mediation. However, many employers will approach mediation unprepared for the specific conversations that will occur during these events.
