In fact, no employment decision leads to more lawsuits than the separation decision. Although legal risk can never be completely eliminated, the strategy and procedure an employer follows to prepare for and conduct a termination can greatly impact the level of legal risk it faces, significantly minimize its potential liability and litigation costs, and place it in the best position to defend itself in any lawsuit arising out of the termination.
