Cross-border thought leadership from Fisher Phillips and Torkin Manes will come together to discuss the evolving world of employee restrictive covenants, and non-competition agreements in particular, across the United States and Canada.
While the free movement of labor is an important policy goal, so is the ability of an employer to protect their business interests by reasonably restricting unfair competition and solicitation (especially vis a vis senior staff and fiduciaries). Unfortunately, the current regulatory climates in both jurisdictions have created great uncertainty among employers, and this one-hour discussion is intended to address both emerging trends and best practices to manage them.
Topics will include:
- A high-level summary discussion of the current state of affairs in respect of restrictive covenant laws across the U.S. and Canada
- The current state and federal actions to ban certain employee non-competition agreements in the U.S.
- The status of restrictive covenants, two years following Ontario’s Working for Workers Act
- How provincial and state restrictive covenant laws may be developing and how best to stay ahead of these trends.
