Philadelphia Attorney Discusses Trade Secret Misappropriation Claims in ABA Journal

Gabrielle Giombetti authored an article in the ABA Journal about pleading trade secret misappropriation claims, and the “delicate balance between specificity and secrecy” that courts across the country are considering when it comes to issuing judgements in these cases.
She discussed a recent instance where the Third Circuit rejected the district court’s overly stringent standard for pleading under the DTSA, ultimately siding with the plaintiff.
“The takeaway for plaintiffs looking to bring misappropriation claims—at least in the Third Circuit—is that while some level of specificity is required, courts understand the inherent pleading challenges that accompany trade secret litigation and will not hold plaintiffs to a pleading requirement beyond plausibility,” she wrote.
