Since the pandemic years, the rise of remote working arrangements has created significant challenges for employers who utilize U.S. immigration programs, as many employment-based visas are intended for temporary workers who are physically employed in a specific office location. Remote workers may inadvertently violate the terms of their visa, exposing an employer to possible liability, and potentially jeopardizing their own legal status. The process of obtaining U.S. Lawful Permanent Residence status has similar requirements related to the geographic place of employment. Additionally, basic hiring and employment authorization (I-9) compliance becomes more complex, as an employer must rely on distant authorized representative or the new, remote “alternative procedure” in verifying an individual’s right to work.
