On August 23, the 5th Circuit struck down the DOL’s 80/20/30 tip credit rule, a significant win for hospitality employers, finding that the DOL’s 2021 interpretation created complex time-keeping and compliance challenges and did not align with the Fair Labor Standards Act. This ruling, however, does not come without questions about what employers need to be doing to comply with wage and hour laws and also create a workplace that attracts and retains skilled talent.
