In an interview with HR Dive, Gregory Murray discusses USERRA, a provision that requires that service member be promoted would they have earned the promotion had that not taken leave. "[USERRA] provides a great amount of protection for people who have been called out for active duty," Greg says. Additionally, he adds that employers should not apply the return-to-work logic they learned from trying to comply with other national employment laws, like the Family and Medical Leave Act or the Americans with Disabilities Act.
