Recent events and changing times have increased exposure to and awareness of violence in the workplace.  Workplace violence can strike anywhere, anytime and no one is immune. According to OSHA, nearly 2 million American workers report having been victims of workplace violence each year. Unfortunately, many more cases go unreported. Workplace violence is defined as any action that may threaten the safety of an employee, impact an employee's physical or psychological well-being, or cause damage to company property.  Homicide is the fourth-leading cause of fatal occupational injury in the United States. This session will focus on developing strategies to prevent and address causes of workplace violence, spotting potential violence and bullying issues, avoidance steps a company may take and the potential effects of the open carry law on all facets of business.

The Devil’s Triangle – Managing Leaves Under ADA, FMLA and Workers’ Compensation

The interrelationship between the Americans with Disabilities Act (ADA) as amended, the Family and Medical Leave Act (FMLA) and Worker’s Compensation is confusing: How do you know which law(s) you are dealing with? Can an employee’s request for a leave be covered by more than one law? When can you request additional information or a second opinion? There are a number of considerations depending on the type of injury, how the employee became injured and their job status at the time. We will discuss how changes in the interpretation of the law have altered how leave must be calculated and given.
