The article “Colorado Employers Free to Fire for Off-Duty Marijuana Use” discussed the Colorado Supreme Court's unanimous decision that employers are still free to prohibit employee marijuana use in their workforces, and can still discipline and terminate employees who test positive for the drug, despite state law permitting its recreational and medicinal use.
Kate said, “You as an employer can still have a zero-tolerance policy, or your company can choose to consider a variety of alternatives such as suspension and/or an EAP program in addition to the option of immediate termination.”
